The Paperwork Illusion: What Attorneys Need to Know About HERS Ratings and New-Home Energy Certifications

When investigating defects in a recently constructed house, attorneys frequently encounter official-looking energy documents bearing a HERS Index score, an ENERGY STAR designation, or a statement that the house complies with the International Energy Conservation Code. The certification may be displayed inside the electrical panel, included in the closing documents, referenced in sales materials, or produced by the builder as evidence that the house was properly constructed.

 

These documents can be relevant, but they cannot be treated as conclusive proof that the completed house complied with the represented energy standards. A certificate establishes that someone completed an energy-rating or code-compliance process and entered information sufficient to generate the document. It does not, standing alone, prove that every modeled component was installed, every required inspection occurred, every diagnostic test was properly conducted, or every data point accurately described the finished construction.

 

The legal and evidentiary question is therefore not merely whether a certificate exists. The more important questions are who selected and paid the evaluator, what inspections and tests were actually performed, what information was entered into the model, whether the installed construction matched those inputs, and whether the underlying records support the representations made to the purchaser.

 

The Builder-Rater Relationship Creates an Inherent Evidentiary Concern

Energy raters and third-party compliance inspectors are commonly presented to purchasers as independent professionals. In production construction, however, the evaluator is ordinarily selected, retained, coordinated, and paid by the builder rather than the eventual homeowner.

 

The distinction matters because the builder may supply hundreds or thousands of assignments to the same rating company. An evaluator who repeatedly identifies failed blower-door tests, excessive duct leakage, missing insulation, incomplete air barriers, noncompliant windows, or other conditions that delay completion can interfere with the builder’s production and closing schedules. The same evaluator’s future revenue may depend substantially on remaining acceptable to that builder.

 

This arrangement does not establish that every builder-retained rating is inaccurate, nor does it prove intentional misconduct by any particular evaluator. It does, however, create an obvious financial relationship that attorneys need to investigate rather than accepting the resulting certificate as the work of a disinterested third party.

 

The evaluator is not retained by the purchaser, does not ordinarily owe the purchaser the same contractual obligations that an independently retained expert would owe, and may depend on the builder for continuing volume business. The builder then uses the evaluator’s work product to support representations about the builder’s own construction.

 

From an evidentiary standpoint, the certificate needs to be analyzed as vendor-generated documentation produced within the builder’s construction and closing process, not as an independent governmental determination that every relevant component of the house was correctly installed.

 

Private Verification Plays a Significant Role in Texas Energy-Code Enforcement

Texas energy-code administration is largely implemented at the local level, and many municipalities do not maintain the personnel, training, time, or diagnostic equipment necessary to perform every energy-related inspection and test internally. Local governments may therefore rely on privately retained energy professionals to perform inspections, blower-door testing, duct-leakage testing, energy modeling, or other compliance services.

 

A municipal approval can consequently depend, in whole or in part, on documentation supplied by a private evaluator retained through the builder’s construction process. The city’s acceptance of that documentation does not necessarily mean a municipal inspector independently repeated the test, inspected every insulation cavity, verified each air-barrier transition, or compared the completed house against every input in the energy model.

 

This distinction becomes important when a builder argues that issuance of a certificate of occupancy or municipal approval conclusively establishes proper construction. Governmental acceptance may show that documentation sufficient for administrative approval was submitted, but it does not necessarily prove that the documentation accurately represented the physical house.

 

The underlying inspection records, photographs, diagnostic files, modeling inputs, field notes, correction notices, and communications remain essential to determining what was actually inspected and verified.

 

Texas Field Research Has Documented Recurring Energy-Construction Deficiencies

Energy-performance defects are not merely theoretical modeling disputes. Texas field research has identified recurring deficiencies involving envelope air leakage, exterior-wall insulation, duct leakage, and ceiling-insulation installation.

 

These conditions can materially affect energy consumption, occupant comfort, humidity control, HVAC operation, indoor-air quality, condensation potential, and the service life of mechanical equipment. They can also contribute to secondary damage when uncontrolled air movement transports moisture into wall, ceiling, or attic assemblies.

 

Research involving Texas houses found a particularly significant difference between compliance with older duct-leakage limits and the more stringent requirements adopted in later energy codes. A house capable of passing an older, weaker standard does not necessarily satisfy the requirements applicable to more recent construction.

 

The applicable code edition, local amendments, construction date, permit date, approved plans, energy-compliance path, and representations made during the sale all need to be identified before anyone concludes that a particular test result established compliance.

 

Code compliance also represents a minimum threshold rather than proof of superior construction. Even a technically compliant house may contain lower-quality installation, greater leakage, or less durable air-sealing details than the purchaser was led to expect through advertising, contractual representations, energy labels, or sales statements.

 

Diagnostic Tests Must Be Examined, Not Merely Referenced

A meaningful blower-door test requires more than placing a fan in an exterior doorway and recording a number. The evaluator must establish the required building configuration, address exterior openings, prepare combustion and mechanical systems as required, install and operate calibrated equipment, create the specified pressure differential, stabilize the test conditions, and accurately document the measured airflow.

 

Duct-leakage testing likewise requires the duct system and registers to be properly prepared, sealed, pressurized, measured, and documented using appropriate equipment and procedures. The result depends on the test configuration, including whether testing occurred before or after drywall, whether the air handler was included, and whether the test measured leakage to the exterior or total system leakage.

 

A summary certificate rarely provides enough information to determine whether the test was conducted correctly. Counsel evaluating a construction-defect claim needs the underlying test data, including the test date, test time, building configuration, equipment identification, calibration information, pressure readings, measured airflow, software output, weather conditions when relevant, photographs, field notes, and the identity and qualifications of the person who performed the test.

 

When the available records consist only of a final certificate and a passing number, the certificate may establish little more than the conclusion the evaluator reported. It does not independently establish the reliability of the methodology used to reach that conclusion.

 

Rating-Industry Quality Assurance Does Not Constitute Independent Retesting of Every House

The HERS industry maintains quality-assurance procedures, but those procedures cannot be equated with a second independent inspection of every certified property. Quality assurance ordinarily involves file reviews, data review, and field review of a limited sample of ratings.

 

The overwhelming majority of certified houses are not subjected to a complete second inspection in which another evaluator independently repeats every field observation, insulation inspection, blower-door test, and duct-leakage test. Most certificates therefore remain dependent on the original rater’s observations, photographs, testing procedures, judgment, documentation, and data entry.

 

Recent RESNET compliance reporting has documented ratings requiring correction and resubmission, failed or deficient reviews, discrepancies between modeled and installed components, inadequate insulation documentation, incorrect ventilation-testing methodology, and required midpoint inspections that were not performed.

 

RESNET has also reported cases involving altered or falsified documentation, preliminary certificates represented as final ratings, questionable blower-door reports, and fabricated registry identification information. These findings do not prove that any particular Texas certificate is false, but they establish that incorrect testing, invalid documentation, and falsification are recognized risks within the national rating system.

 

A certificate cannot therefore be authenticated merely by pointing to the existence of an industry quality-assurance program. The particular rating file still needs to be examined.

 

Photographic Documentation Can Be Incomplete or Misleading

Energy-rating files commonly rely on photographs to document insulation depth, framing cavities, air barriers, duct sealing, mechanical equipment, windows, and other modeled components. Photographs can be valuable evidence, but they also present obvious limitations.

 

An image of an insulation-depth marker does not necessarily establish that the required depth existed throughout the attic. The marker may have been placed in a localized area, positioned inaccurately, bent, folded, or framed in a manner that excluded surrounding deficiencies.

 

A photograph showing one insulated wall cavity does not establish that every cavity was filled, that batts were not compressed, that insulation was correctly fitted around wiring and piping, or that concealed areas behind tubs, fireplaces, stairs, and mechanical chases were completed.

 

Photographs must be evaluated for date, location, sequence, metadata, continuity, and relationship to the house at issue. Counsel also needs to determine whether the images depict the subject property, a representative model, another house constructed from the same plan, or conditions that were subsequently altered.

 

The absence of photographs may be equally important when the applicable rating protocol required a midpoint inspection or documentation of components that would later become concealed.

 

The Energy Model May Describe the Plans Rather Than the Finished House

A HERS rating is based substantially on a computer model incorporating assumptions about the building envelope, windows, insulation, HVAC equipment, duct systems, ventilation, lighting, and appliances. A projected rating may be generated from plans and specifications before construction is complete, with later field inspections and testing intended to convert the projected result into a confirmed rating.

 

The reliability of the final score depends on whether the model was updated to reflect the house that was actually built.

 

A model may assume that every wall cavity was fully insulated, attic insulation was installed uniformly at the specified depth, top plates and penetrations were sealed, windows matched the specified U-factor and solar heat-gain coefficient, ducts were installed within the represented pressure boundary, and the HVAC equipment matched the approved specifications.

 

Actual jobsite conditions often depart from those assumptions. Insulation may be missing or compressed, air barriers may be discontinuous, windows may differ from the scheduled products, ducts may be crushed or disconnected, penetrations may remain unsealed, and workers may disturb insulation after the rating inspection.

 

Unless those deviations were identified and incorporated into the confirmed rating, the software may calculate the theoretical performance of the planned house rather than the performance of the completed structure conveyed to the purchaser.

 

For litigation purposes, the certificate and summary report need to be compared against the approved plans, specifications, product schedules, equipment data, window labels, insulation documentation, construction photographs, change orders, field observations, and the existing house.

 

A Favorable Rating Is Not a Guarantee of Actual Performance

A HERS Index score is a comparative modeled result. It is not a warranty of future utility costs, indoor comfort, humidity levels, air quality, or defect-free construction.

 

Actual energy consumption varies with weather, thermostat settings, occupancy, appliance use, maintenance, and occupant behavior. Those variables do not eliminate the relevance of construction defects, however, particularly when the house materially departs from the physical characteristics entered into the model.

 

A builder may argue that high utility bills result entirely from occupant conduct. A homeowner may assume that any bill exceeding a projected amount proves defective construction. Neither conclusion can be accepted without technical analysis.

 

The proper inquiry is whether the envelope, insulation, windows, duct system, HVAC equipment, ventilation system, and other energy-related components conform to the applicable requirements and to the conditions represented in the rating model. Diagnostic testing, physical inspection, utility analysis, weather normalization, equipment-performance evaluation, and review of occupant operation may all be necessary to separate construction-related losses from usage-related consumption.

 

The certificate remains one item of evidence within that analysis. It cannot replace the analysis.

 

Field Conditions Commonly Contradict the Certification Narrative

During inspections of newly constructed houses, I have observed fresh energy certificates displayed inside electrical panels while substantial energy-related defects remained readily identifiable elsewhere in the house.

 

Those conditions have included attic areas with no insulation, partially insulated ceilings, incomplete insulation coverage, disconnected exhaust ducts, exterior dampers prevented from closing, visible gaps between window sashes and frames, and other discontinuities inconsistent with the assumptions ordinarily used in an energy model.

 

A disconnected kitchen exhaust duct, for example, can discharge heat, moisture, grease, and cooking contaminants into the attic rather than outdoors. An exterior damper obstructed by improper screening can remain open and allow uncontrolled outdoor air into the building.

 

A vinyl window with visible gaps between the sash and frame does not perform like the sealed fenestration product represented by its laboratory rating. Missing attic insulation does not become effective merely because an insulation value appears in the model.

 

These conditions may remain absent from the rating file because a rater’s assignment is not necessarily equivalent to a comprehensive new-construction inspection. The evaluator may focus on specific model inputs and prescribed tests while defects outside the limited rating protocol remain undocumented.

 

Attorneys therefore need to distinguish between the scope of the energy rating and the broader question of whether the completed house was properly constructed.

 

Potential Legal Issues Depend on the Representations and Supporting Evidence

The existence of inaccurate energy documentation may implicate several legal theories, but the viability of any particular claim depends on the contracts, warranties, sales representations, applicable statutes, reliance evidence, notice history, limitations, causation, and damages.

 

Relevant questions may include whether the builder expressly represented that the house complied with a specific energy code, achieved a particular HERS score, qualified for an ENERGY STAR designation, contained specified insulation or windows, or would provide particular performance characteristics.

 

Counsel may also need to determine whether the rating document was incorporated into the sales transaction, provided before closing, used in advertising, relied upon by the purchaser, or later invoked by the builder in response to a complaint.

 

An incorrect certificate does not automatically establish fraud, negligence, breach of contract, statutory liability, or recoverable damages. It may, however, become significant when the underlying records show that required inspections were omitted, modeled components were not installed, failed tests were disregarded, preliminary documents were represented as final, known discrepancies were not corrected, or the certificate was used to induce or reassure the purchaser.

 

The distinction between mistake, deficient workmanship, negligent verification, reckless disregard, and intentional falsification depends on the evidence. Obtaining the complete rating and construction files early is therefore critical.

 

Discovery Needs to Extend Beyond the Certificate

A request for “the HERS certificate” is ordinarily insufficient. The certificate is the conclusion document, not the complete evidentiary file.

 

Relevant materials may include the projected and confirmed rating reports, energy models, software files, registry records, inspection checklists, field notes, photographs, metadata, midpoint-inspection documentation, blower-door reports, duct-leakage reports, ventilation-testing records, equipment serial numbers, calibration records, correction notices, failed test results, revised submissions, quality-assurance reviews, communications with the builder, and documents identifying who performed each inspection and test.

 

Construction records may also be necessary, including approved plans, energy-compliance documents, Manual J, S, and D calculations when applicable, HVAC submittals, window schedules, product labels, insulation certificates, subcontractor scopes, change orders, inspection logs, municipal submissions, closing documents, sales literature, warranty representations, and communications concerning energy complaints.

 

Discovery needs to identify the commercial relationship between the builder and rating company, including the length of the relationship, number of houses rated, fee arrangement, volume discounts, builder scorecards, performance expectations, rejected reports, demands for expedited approvals, and communications concerning delayed closings.

 

Those facts may illuminate whether the evaluator operated with meaningful professional independence or functioned principally as another production vendor subject to the builder’s schedule and economic control.

 

Preservation of Electronic and Diagnostic Evidence Is Essential

Energy-rating evidence may exist in electronic systems that are not captured by a printed certificate. Modeling software, cloud registries, testing devices, mobile applications, photographs, metadata, and provider databases may contain information identifying when data was created, edited, uploaded, replaced, or resubmitted.

 

Diagnostic equipment may store test files or result histories. Photographs may contain timestamps, geolocation information, device identifiers, or sequence data. Registry systems may record preliminary and final submissions, corrections, quality-assurance activity, and the identity of persons who accessed or modified the file.

 

Preservation demands need to address native electronic files rather than only printed reports or screenshots. The relevant entities may include the builder, rating company, individual rater, rating provider, HVAC contractor, insulation contractor, energy consultant, software provider, and any quality-assurance organization involved in the rating.

 

When authenticity or alteration is disputed, native data and associated metadata may be substantially more probative than the final PDF produced during ordinary discovery.

 

Independent Testing Can Confirm or Undermine the Builder’s Documentation

An independent evaluation can determine whether the finished house performs consistently with the builder’s certificate, but the testing needs to be properly designed and interpreted.

 

Blower-door testing can quantify whole-building air leakage. Duct-leakage testing can evaluate the distribution system. Infrared thermography, when conducted under suitable temperature and pressure conditions, can help identify insulation voids, displaced insulation, air leakage at top plates, discontinuities around windows, and concealed thermal anomalies.

 

Visual inspection remains necessary because diagnostic numbers alone may not identify the location, cause, or repair implications of the leakage. A house can produce an aggregate test result without revealing which assemblies are defective, and later alterations can affect the relationship between current testing and original construction.

 

The independent evaluator also needs the original rating file. Without the original inputs and test configuration, a new result may establish current performance but provide limited information about whether the original certificate was accurate when issued.

 

Effective expert analysis ordinarily requires comparison of the original model, represented construction, installed components, historical records, current physical conditions, and independent test results.

 

Causation and Damages Require More Than a Defective Certificate

An inaccurate certificate may be compelling evidence, but damages still require a defensible causal analysis.

 

Potential damages may include the reasonable cost to investigate and repair insulation, air-sealing, window, duct, ventilation, and HVAC defects; costs associated with removing and replacing finishes to access concealed conditions; increased utility expenses attributable to construction deficiencies; loss of use; damage to materials caused by moisture migration; reduced equipment life; and diminution in value when appropriate and legally recoverable.

 

Utility-bill claims need careful treatment because bills reflect both building performance and occupant behavior. Comparison with neighboring houses is often unreliable unless the houses, orientations, equipment, occupants, thermostat settings, and usage patterns are sufficiently similar.

 

Repair-cost opinions likewise need to address the actual scope required to reach the represented or legally required condition. Superficial sealing of accessible gaps may not correct concealed discontinuities, missing insulation, improperly installed windows, or duct systems located outside the intended pressure boundary.

 

The expert must connect the physical defect to the claimed consequence and distinguish code-minimum corrections from upgrades that exceed the contractual or statutory measure of damages.

 

Code Compliance Is a Minimum Requirement, Not a Premium Benefit

Builders and sales representatives frequently market energy-code compliance as a special feature. In reality, compliance with the applicable adopted code is ordinarily the minimum construction requirement, not an optional luxury upgrade.

 

A representation that a house “meets code” does not establish exceptional workmanship, and a certificate reciting code compliance does not prove that the underlying work was inspected correctly.

 

Even genuine compliance does not establish that the builder used the best available insulation installation, the tightest practicable duct system, the most efficient windows, or the most durable air-sealing details. The legal significance depends on what the builder was required to provide and what the builder represented that it had provided.

 

When premium pricing, energy-efficiency marketing, green-building claims, or specific performance representations formed part of the transaction, the difference between bare code compliance and the promised level of performance may become material.

 

The Certificate Is Evidence, Not the Final Answer

A new-home energy certificate may be accurate, carefully prepared, and supported by competent field verification. The document itself does not establish that those things occurred.

 

Texas field research has documented recurring deficiencies involving envelope leakage, duct leakage, and insulation installation. Rating-industry quality-assurance reports have documented corrected ratings, failed reviews, improper testing, missed inspections, inaccurate inputs, altered documents, and falsified information.

 

The builder-retained business structure also warrants scrutiny. The builder commonly selects and pays the evaluator, controls the volume of future assignments, coordinates the evaluator’s access, and uses the resulting certificate to support the builder’s own representations to the purchaser.

 

For attorneys investigating energy-related construction defects, the appropriate approach is not to disregard the certificate but to test it. The certificate needs to be traced back to the inspections, measurements, photographs, electronic data, modeling assumptions, and communications from which it was produced.

 

Genuine energy performance is established through the physical house, competent testing, accurate documentation, and a defensible comparison between the construction represented and the construction delivered. A professionally designed sticker inside an electrical panel may be part of that evidence, but it is never a substitute for it.
